1. Introduction
These terms and conditions (“Terms”) govern your use of the BrainVista Tutors website and the tuition services we provide. By using our website or booking a session with us, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
2. Definitions
- “BrainVista”, “we”, “us”, “our” refers to BrainVista Tutors.
- “Client”, “you”, “your” refers to the parent, guardian or adult learner booking or using our services.
- “Student” refers to the individual receiving tuition.
- “Tutor” refers to any individual delivering tuition on behalf of BrainVista Tutors.
- “Services” refers to online and in-person tuition, free assessments, and related educational support offered by BrainVista Tutors.
3. Booking & Payment Terms
Sessions are booked following a free assessment, subject to tutor availability. Payment is due in advance of each session or block of sessions, by bank transfer or card payment, unless otherwise agreed in writing.
Prices for tuition are confirmed with each family individually before booking begins, and may be subject to change with at least 30 days’ notice for existing clients. Term bundles and package bookings are paid in full at the start of the term and are non-transferable between students.
4. Cancellations & Rescheduling
We understand that plans change. Clients are asked to provide at least 24 hours’ notice when a session needs to be cancelled or rescheduled. Sessions cancelled with less notice than this may be charged in full, except in genuine emergencies.
Where BrainVista Tutors needs to cancel or reschedule a session — for example due to tutor illness — we will notify you as soon as possible and offer an alternative time or, where applicable, a credit towards a future session.
5. Tutor Conduct & Safeguarding
All BrainVista tutors are expected to maintain professional conduct at all times and to prioritise the safety and wellbeing of students. Safeguarding is treated as a core responsibility, particularly for in-person sessions delivered in a family home. In-person tutors are required to hold a valid Enhanced DBS check before working with students, renewed periodically in line with safeguarding best practice.
Any concerns about tutor conduct should be raised immediately via our Contact page so they can be investigated promptly.
6. Intellectual Property
All content on the BrainVista Tutors website, including text, graphics, logos and teaching materials created by BrainVista, remains the intellectual property of BrainVista Tutors or its licensors. You may not reproduce, distribute or repurpose this content for commercial use without our prior written consent. Materials shared with a student during tuition are provided for that student’s personal educational use only.
7. Limitation of Liability
BrainVista Tutors provides tuition services with reasonable care and skill, but we cannot guarantee specific academic outcomes, grades or exam results, as these depend on many factors outside our control. To the maximum extent permitted by law, BrainVista Tutors will not be liable for any indirect or consequential loss arising from use of our services. Nothing in these Terms limits our liability for matters which cannot lawfully be limited or excluded, such as death or personal injury caused by our negligence.
8. Use of Our Website
You agree to use the BrainVista Tutors website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the site by anyone else. This includes not attempting to gain unauthorised access to any part of the website, its systems or related networks, and not using the website to transmit any harmful or unlawful material.
While we take reasonable steps to keep our website accurate, secure and up to date, we do not guarantee that it will be free of errors, uninterrupted, or entirely secure, and we accept no liability for any loss arising from reliance on website content without independent verification.
9. Complaints
If you are unhappy with any aspect of our service, please raise this with us as soon as possible via our Contact page. We aim to acknowledge complaints within two working days and to reach a resolution within 14 days wherever possible.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.
